On August 31, 2006, the Texas Supreme Court issued an opinion in Fiess v. State Farm Lloyds, which will have a great impact on litigation involving mold in Texas. The question presented to the Court in this case was whether the language in a Homeowners Form B (HO-B) insurance policy, as such policy forms are prescribed by the Texas Department of Insurance, provides coverage for mold contamination caused by water damage that is otherwise covered by the policy.
