Austin REALTOR Group Urges City to Exclude "Point of Sale" from Climate Protection Plan

February 8, 2007 - An ambitious plan unveiled by Mayor Will Wynn on Wednesday aims to decrease global warming through energy conservation. The climate protection plan includes a requirement to make efficiency improvements in existing homes and buildings at the time of sale. The Austin Board of REALTORS® welcomes the opportunity to collaborate with the City of Austin on the climate protection proposal.

The Austin Board of REALTORS® ABoR) strongly recommends that the City of Austin refrain from disrupting the current process for private property conveyance and instead use education and incentives to motivate consumer compliance.

"Requiring homeowners to meet energy mandates at the time of sale is an obstacle that could unnecessarily complicate and ultimately delay the home sales process," said David M. Foster, president and CEO of the Austin Board of REALTORS®. "Consumer education and incentives such as rebates for energy compliance offer a positive means of achieving climate protection goals."

Historically, private property transactions in Texas have been regulated by the State of Texas. Granting the City of Austin the right to mandate private property transactions could result in costly legal ramifications for consumers. ABoR urges REALTORS® and homeowners to request that the City Council withdraw the "point of sale" verbiage from the climate protection plan.
