Release of Liability and Assumption of Risk Agreement
By registering for and/or attending an event, meeting, and/or conference (“Event”) sponsored, hosted, or coordinated by the Austin Board of REALTORS® (“ABoR”), I agree to the following:
COVID-19 Warning. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. COVID-19 can cause serious and potentially life-threatening illness and even death. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, restricted the congregation of groups of people. For the purposes of this Agreement, whenever reference is made to COVID-19, the reference shall include COVID-19 and any and all variants of COVID-19.
Release. I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 in order to participate in the Event. I release, and waive my right to bring suit against, ABoR and its officers, directors, managers, officials, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to participating in the Event or in any other in-person events or activities sponsored or coordinated by ABoR (“ABoR Activities”). I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence, and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.
Agreement to Follow Procedures. I agree to adhere to preventative measures to reduce the spread of COVID-19 at Event and at any other ABoR Activities. Per Centers for Disease Control (CDC) guidelines, fully vaccinated individuals may resume activities without wearing a mask or social distancing. ABoR no longer requires wearing masks in our facilities and encourages members and the public to use their discretion when entering the premises. We request that non-vaccinated members continue to wear a mask and maintain social distancing.
Certification. I also certify and agree as follows:
- I have not been diagnosed with, demonstrated any symptoms of, or been exposed to anyone who has been diagnosed with COVID- 19 within the past fourteen (14) days.
- I will use my best efforts to minimize the health risk to all participants present at the Event. This includes but is not limited to sanitizing hands, wearing a protective face covering, and practicing social distancing if I am not fully vaccinated.
- I will notify ABoR by e-mailing firstname.lastname@example.org if I become aware of information that poses a danger previously unknown, such as a positive COVID-19 test or the development of COVID-19 symptoms in myself or other contacts within fourteen (14) days of the Event.
Video & Photography Release
By registering for and/or attending an ABoR event, class, meeting, or virtual program ("Event"), I understand that I may be photographed and/or videotaped. I hereby consent to and authorize the use and reproduction by ABoR of any and all photography and/or videography that has been taken of me during the Event, without compensation to me. All digital image and/or video files are wholly owned by ABoR, who reserves the right to use these images and/or video for Association and MLS marketing purposes.
ABoR does not tolerate any form of discriminatory, sexual, or other unlawful harassment, including any harassment based on race, color, religion, sex, national origin, age, disability, or legally protected group status. This policy applies to and protects all ABoR employees, members, vendors, contractors and consultants, and all guests and participants in any ABoR event or programming, onsite or offsite of ABoR facilities, in person or virtual. ABoR reserves the right to terminate participation with no refund for any person who violates this policy.
